Welcome, dear User!

To make the use of our services as comfortable and safe as possible, we have created this Agreement. It helps us agree on how to properly and efficiently use our services.

This Agreement is a public offer addressed to anyone interested, and acceptance of the Agreement occurs if you perform any of the following actions:

• paid for the services;

• registered in the personal account;

• added funds to the balance;

• started using the services (even free or connected without payment).

We highly value each of our Users, so the terms of this agreement are the same for everyone – this ensures stable and high-quality services.

If for any reason you do not agree with the terms or do not wish to continue using the services, please stop registration or use of our services.

We are confident that our cooperation will be convenient and beneficial for you!

An individual or legal entity that has accepted this Agreement.

Agreement
This document regulates the relationship between the Provider and the User regarding the use of ogwplay.games and all subdomains of ogwplay.games.

2. Subject

2.1. The Provider offers the User server rental services for hosting:

2.1.1. Minecraft game servers (including ready-made builds):

• can be public or private, depending on the chosen plan;

• virtual access to the server is provided, including a control panel and FTP (SFTP) access;

• technical specifications are indicated during the ordering process.

2.1.2. Virtual servers (VPS/VDS):

• can be public or private, depending on the plan;

• each VPS/VDS server is assigned a dedicated IPv4 address. The User independently configures the system, software, and network settings;

• processor parameters and frequency are specified in the plan descriptions.

2.2. Services include computing resources, software solutions, and administrative access within the chosen plan.

2.3. Services are provided “as is”, without any guarantees that they will meet the User's individual requirements or expectations. The User accepts them as provided.

3. Ready-made Minecraft server builds

3.1. The Provider grants access to intellectual property in the form of server builds according to the chosen plan.

3.2. Builds may include modifications, settings, plugins, and other components.

3.3. Full build descriptions are provided on the order page.

3.4. No refunds are available for purchased builds.

3.5. The Provider is not responsible for:

• plugin or mod operability, whether included or not included in the build;

• builds are supported technically for 30 calendar days.

3.6. Usage restrictions:

• only for personal use;

• distribution, transfer, or resale to third parties is prohibited;

• all rights belong to the Provider or the respective plugin right holders.

3.7. Intellectual property violations incur a fine of 100,000 RUB per violation.

3.8. The Provider may:

• block the User’s account;

• suspend services;

• file a lawsuit for damages.

4. Plans

4.1. Services are provided under plans published on the website.

4.2. Users independently choose their plans and are responsible for their choices.

4.3. “Lifetime” plans are valid until the Provider ceases operations but for no less than 30 months.

4.4. When changing a plan:

• the location remains the same unless changed separately;

• the processor model remains as originally provisioned;

• specifications may differ by location.

4.5. Changing locations is possible no more than once per week and only at the Provider’s discretion. The Provider may refuse without explanation.

5. Configuration and knowledge base

5.1. Server configuration is entirely the User’s responsibility.

5.2. Lack of configuration skills is not grounds for claims or refunds.

5.3. The Provider offers a knowledge base on the website for self-configuration.

5.4. The knowledge base is for informational purposes only and provided “as is.”

5.5. Users are responsible for any configuration errors resulting from its use.

6. Registration procedure

6.1. Users must provide valid data: name, email, phone number, country.

6.2. The Provider may suspend or block accounts for suspicious activity.

6.3. When paying via “Subscription,” funds are debited automatically.

6.4. Removing a payment card requires a support request.

6.5. Accounts inactive for more than 12 months may be deleted.

6.6. Users agree to receive promotional emails but may unsubscribe anytime.

7. Limitation of liability

7.1. The Provider guarantees server operation within technical specifications but does not provide administration services.

7.2. The Provider is not responsible for:

• User equipment and networks;

• operating system or application errors under User control;

• blocks or sanctions caused by the User;

• the operation of third-party software.

8. Resource usage limitations and prohibited actions

8.1. Users must comply with resource usage norms.

8.2. Prohibited actions:

• continuous CPU/RAM load at 100%;

• cryptocurrency mining;

• stress tests;

• DDoS/DOS attacks, flooding, spamming, brute force, port scanning, botnets.

Violations result in service suspension without refund.

9. Server settings and management

9.1. Users may install mods and plugins if they do not pose a security threat.

9.2. Any outbound attacks are prohibited.

9.3. Changes to launch strings require a support request.

9.4. The Provider may block servers for:

• suspicious activity;

• registration via anonymous networks;

• false personal data;

• use of temporary emails.

9.5. Users are responsible for:

• third-party actions using their credentials;

• illegal information hosting;

• malware usage or distribution.

10. Payment, activation, and financial obligations

10.1. Services activate after payment.

10.2. In some cases, activation may take up to 24 hours.

10.3. Overdue payments result in suspension and potential data deletion.

10.4. Refunds are available only for technical failures exceeding 120 hours per month, confirmed by support, and only to the payer’s account.

10.5 We partner with Tebex Limited (www.tebex.io), who are the official merchant of digital content produced by us. If you wish to purchase licenses to use digital content we produce, you must do so through Tebex as our licensed reseller and merchant of record. In order to make any such purchase from Tebex, you must agree to their terms, available at https://checkout.tebex.io/terms. If you have any queries about a purchase made through Tebex, including but not limited to refund requests, technical issues or billing enquiries, you should contact Tebex support at https://www.tebex.io/contact/checkout in the first instance.

11. Refund policy

11.1. Refunds are issued only for technical failures exceeding 120 hours in a calendar month, confirmed by support.

11.2. Refunds are only issued to the payer’s account.

11.3. Refunds are not issued for:

• “lifetime” services;

• lack of User configuration skills;

• Agreement violations;

• partial month usage;

• credit balances.

12. Technical support

12.1. Requests are accepted only in Ukrainian or English.

12.2. Support hours: daily, 10:00–19:00 EET.

12.3. Prohibited during support interaction:

• obscene language;

• disrespect towards staff;

• demands violating the Agreement.

13. Referral program

13.1. Users may participate as partners.

13.2. Partners receive 10% of referral purchases after 30 days.

13.3. Minimum withdrawal is $10.

13.4. Payments are made to internal balance or bank cards.

13.5. Violations (multi-accounts, self-registration) void accrued earnings.

14. Miscellaneous

14.1. The Provider may amend the Agreement unilaterally. The new version takes effect upon publication at ogwplay.games/agreement.html

14.2. Continued use indicates acceptance of changes.

14.3. Disputes are resolved through the ticket system in the billing panel.
